1. By permitting Suzuki GB to use particular Content (by affirmatively answering a request from us or on our behalf on social media or otherwise indicating your agreement for Suzuki GB to use your Content), you agree to be bound by these Terms.
   
2. In these Terms “Content” refers to the photo [and/or video, including any sound] and accompanying text posted through your account on social media, accompanying metadata such as time and place of creation, your user name, and links to your social media profile.
   
3. You grant Suzuki GB a right to use and display the Content, in any media, worldwide, for any lawful commercial purpose, in original or edited form, including: on Suzuki GB’s social media accounts, websites, blogs, digital displays, advertising, and generally in the promotion of Suzuki GB’s products or services. Such rights also extend to Suzuki GB’s subsidiaries, affiliates, agents, employees, representatives, assigns, licensees, and anyone else acting on behalf of Suzuki GB.
   
4. Suzuki GB’s rights to use your Content indefinitely until canceled by you, which you can do at any time by contacting Suzuki GB by email: legalservices@suzuki.co.uk or by post: Suzuki GB Plc, Steinbeck Crescent, Snelshall West, MIlton Keynes MK4 4AE. After cancellation we will not reuse your Content. However, please note that past posts may remain visible and Suzuki GB will retain your Content for 2 years after cancellation.
   
5. The rights you grant to Suzuki GB are non-exclusive and (subject to Suzuki GB’s rights) you retain all rights to use the Content for your own purposes. Suzuki GB will not pay any royalties or compensation to you or any third party for use of the Content. Use is at Suzuki GB’s discretion and Suzuki GB is not obliged to use your Content in any particular way or at all.
   
6. You agree that you do not have any right to review, approve, or object to Suzuki GB’s use of your Content or advertising copy, or to be identified as the author/creator of the Content.
   
7. Suzuki GB respects applicable laws and the rights of others and wishes to avoid using any content that does not. By agreeing to these Terms you represent and warrant to Suzuki GB that:
   1. the Content is your original work and you own it and all intellectual property rights in it and have all necessary rights to grant Suzuki GB the rights set out in these Terms (including in relation to copyrights, trademarks, private or public buildings, performances, sounds, and music) or, if you are not the owner of such rights, you have already obtained permission from the owner of such rights, and will inform us if this is incorrect or such permission is withdrawn at any time;
   2. Suzuki GB’s use of your Content as provided herein will not infringe intellectual property, privacy, image, performance, or publicity rights, or any other rights of any third party, require the; payment of any compensation to any third party, or breach any applicable laws;
   3. nothing in your Content will be illegal, defamatory, obscene, or threatening to any third party; and
   4. you are over 18 years of age and have the right to agree to these Terms.
8. You will hold Suzuki GB’s harmless and indemnify Suzuki GB against any actions, loss and damage arising out of any claims by third parties in connection with the Content, including for breach of intellectual property, data protection, privacy, image, performance, or publicity rights.
   
9. The Content may contain information about you or identifiable individuals which constitutes personal data under applicable laws.
   
10. By agreeing to these Terms you give your consent to the processing of such personal data by Suzuki GB for the purposes set out in these Terms.
    
11. Where any personal data relating to any other person appears in the Content you warrant that you also have obtained their consent for processing of such personal data.
    
12. Suzuki GB will process personal data included in the Content or otherwise provided to us in connection with our use of the Content in accordance with all applicable data protection laws and our privacy policy available here: https://cars.suzuki.co.uk/privacy
    
13. Suzuki GB is the controller of your personal data and individuals can obtain further information or exercise any of their legal rights by contacting Suzuki GB at: legalservices@suzuki.co.uk. Suzuki GB also engages data providers or service providers to assist with the processing of personal data, including Qubeeo Limited, located in the UK, who provides content curation, hosting, showcasing, and analytics services.

These are the terms and conditions (“Rules”) that apply to the Suzuki Seasonal Prize Promotion (“Promotion”). By entering the Promotion, each entrant agrees to these Rules and confirms they have read and understood our Privacy Notice at https://cars.suzuki.co.uk/privacy. Please also see how we limit our liability in the “Liability” section below.
 

1. Promoter: Suzuki GB Plc, a company registered in the United Kingdom (company no. 00768587) with its registered office address at Steinbeck Crescent, Snelshall West, Milton Keynes, Buckinghamshire MK4 4AE (“Suzuki”).
2. Entry period: The Promotion opens for entry at [10am] on [Friday 15th December] and closes at [11:59pm] on [Sunday 31st December] (“Entry Period”).
3. Eligibility: Entry is open to legal residents of the United Kingdom (England, Scotland, Wales and Northern Ireland only) who are at least 18 years old at the time of entry. The Promotion is not open to employees and contractors of Suzuki, their families and households and anyone else professionally involved or associated with the Promotion. Suzuki reserves the right at any time to require proof of eligibility in such form as Suzuki reasonably considers necessary.
4. Limit on number of entries: A limit of one (1) entry per person applies to this Promotion. Suzuki reserves the right at any time to disqualify anyone found to have entered more than once, including by using multiple accounts.
5. How to enter: The Promotion can be entered in only one way, this being on the Suzuki cars website:
   Website entry: Find the Promotion page on the Suzuki cars website at [Swift Eras | Suzuki Cars UK]. Click on the StoryStream upload button and then upload the photograph of your Suzuki Swift together with [a fun or happy story about your Suzuki (not limited to just Swifts)]. Your photograph must be in [.jpg/.jpeg] format and must upload successfully. Your story should be no more than approximately [50] words in length.
6. Submission guidelines: All entries must comply with the following submission guidelines (“Submission Guidelines”):
   • entries will be public and therefore entrants must only post information about themselves that they are happy for others to see and must not post any information about any other identifiable person unless that other person (or their parent or legal guardian if a minor) has given written consent (a copy of which must be provided to Suzuki if requested);
   • photographs must not include any identifiable person other than the entrant unless that other person (or their parent or legal guardian if a minor) has given written consent (a copy of which must be provided to Suzuki if requested);
   • photographs must be the entrant’s own original photograph and must not infringe the intellectual property rights, privacy rights or other rights of any person or business;
   • photographs must not include anything protected by third-party copyright or trade mark rights, including third-party branding or logos;
   • entries must not be, or contain any material which is, or may reasonably be considered to be, threatening, defamatory, inflammatory, obscene, indecent, offensive, profane, abusive, pornographic, sexually explicit or suggestive, violent, derogatory of any ethnic, racial, gender, religious, professional or age group, or discriminatory in any way;
   • entries must not be or contain anything that is false or misleading or otherwise unlawful;
   • entries must not be generally offensive, rude, mean-spirited or in bad taste, as determined by Suzuki in our sole discretion; and
   • entries must not defame, misrepresent or contain disparaging remarks about Suzuki or our products or services, or about other people, businesses or third-party products and services.
7. Prizes: There are [80] prizes to be won in this Promotion, consisting of a Seasonal Vintage Suzuki Swift Socks (“Prizes”).
8. Prize conditions: Prizes are non-transferable, non-refundable, non-exchangeable and no cash alternative is available. However, if Suzuki considers it appropriate, or if it becomes necessary for reasons beyond Suzuki’s control (e.g. if a Prize becomes unavailable for any reason), a Prize may be varied or swapped for a suitable alternative in Suzuki’s discretion.
9. Winner selection: All eligible entries that comply fully with these Rules (including the Submission Guidelines) will be entered into a random draw to select the winners on [Thursday 4th January]. The winners will be the entrants whose names are drawn at random from all eligible entries.
10. Winner notification: Winners will be notified by email within Seven (7) days of the completion of the winner selection process. Suzuki will make reasonable efforts to contact the winners, but it is each winner’s responsibility to monitor their email address (including spam folder) for receipt of the notification.
11. Claiming the Prize: The winners must claim their Prizes within 14 (fourteen) days of Suzuki’s initial win notification by providing their postal address and any other information requested. If a winner fails to claim their Prize or fails to provide any information requested by Suzuki by the claim deadline, Suzuki reserves the right to disqualify the winner and select an alternative winner. The alternative winner will be selected using the same process as the original selection process and must claim the Prize within 14 (fourteen) days of Suzuki’s win notification.
12. Prize delivery: Prizes will be delivered to each winner at the postal addresses notified to Suzuki during the claim process. Prizes will be delivered within 30 (thirty) days of a valid claim, unless a later delivery date is agreed with a winner during the claim process.
13. Liability: Nothing in these Rules limits or excludes any person’s liability for death or personal injury caused by negligence, for fraud or for any matter for which liability cannot be lawfully limited or excluded. In particular, consumers have legal rights in relation to products that are faulty or not as described and services which are not performed with reasonable care and skill and these legal rights are in addition to and are not affected in any way by anything contained in these Rules. Except as stated above, and to the extent permissible by law, Suzuki will not be liable for any loss or damage you suffer as a result of your participation in the Promotion and receipt or use of the Prize in circumstances where: (i) there has been no breach of a legal duty of care owed to you by Suzuki; (ii) it was not obvious that you would suffer such loss or damage and nothing you said to Suzuki before you entered this Promotion meant that Suzuki should have expected it to happen (so, in the law, the loss was “unforeseeable”); (iii) you could have avoided such loss or damage by taking reasonable action; and/or (iv) the loss or damage was caused by an event or circumstance beyond Suzuki’s reasonable control (including any unavailability of Suzuki’s websites, apps or social media accounts). In addition, this Promotion is only open to individual consumers and therefore Suzuki is not responsible for any business loss or damage, such as loss of profits or revenue, loss of anticipated savings or loss of goodwill.
14. Cancellation and variation: Suzuki reserves the right to vary, suspend or cancel the Promotion and/or these Rules if it considers it necessary or appropriate to do so, including if there is any actual or anticipated breach of applicable law or if variation, suspension or cancellation is necessary due to an event outside Suzuki’s reasonable control. In the event of cancellation, Prizes may be awarded to winners drawn from entries received prior to cancellation.
15. Disqualification: Without limiting the options available to Suzuki, Suzuki reserves the right at any time to disqualify entries or entrants that Suzuki regards as being in breach of these Rules, any applicable laws, any terms and conditions referred to in these Rules and/or the spirit of the Promotion.
16. Interference with the Promotion: Any attempt to damage or undermine the content or legitimate operation of the Promotion is prohibited and may also be a violation of criminal and/or civil laws. Suzuki reserves all its rights and remedies to deal with breaches or suspected breaches of this section including, without limitation, to exclude any entrant or winner believed to be associated with such activity.
17. Publicity: By entering the Promotion, each entrant agrees that, in the event of a win, Suzuki shall be entitled (but not obliged) to announce their names (and/or social media handles if applicable) on Suzuki’s websites and social media. By entering the Promotion, all entrants grant to Suzuki a non-exclusive, perpetual, worldwide licence to use (and to grant a sub-license to Suzuki group companies and other third parties to use) their photograph and/or story for the purpose of administering the Promotion and Prize fulfilment, for internal business purposes, for publicity purposes connected with the Promotion and for general advertising, marketing and PR purposes. This licence includes (without limitation) the right to edit, modify and adapt the entry, to incorporate the entry into or combine it with other materials, and to publish the entry in any media, including on Suzuki’s websites and social media. Entrants may also be asked (without further reward) to take part in reasonable publicity connected with the Promotion.
18. Disclosure of winner’s details: By entering the Promotion, each entrant acknowledges that in the event of a win their surname and county of residence may be disclosed to persons enquiring, where permitted by law. Any entrant may object to their information being made available in this way, or may request that the amount of information made available be reduced, by contacting Suzuki using the contact details at the end of these Rules. In these circumstances, the entrant acknowledges that Suzuki may nevertheless disclose the relevant information and the entrant’s entry to the Advertising Standards Authority (and/or any other competent authority) if required to do so. By way of example, this may happen where Suzuki is required to demonstrate that it has awarded any advertised prizes. To request disclosure of winner details, enquirers must submit a request to [4wmarketing@suzuki.co.uk] within one (1) month following the end of the Entry Period. Details will only be disclosed (if permitted by law) after all Prizes have been awarded.
19. Personal data: Entrants acknowledge that any personal data processed in connection with the Promotion will be processed in accordance with Suzuki’s Privacy Notice, which is available at https://cars.suzuki.co.uk/privacy.
20. Accessing these Rules: Any website on which these Rules are posted is only intended to be accessed from the United Kingdom and where permitted by law. Suzuki makes no representation that materials relating to the Promotion are appropriate or available for use at other locations. Access to them from territories where their contents are illegal is strictly prohibited.
21. Severance and waiver: If any part of these Rules is or becomes invalid, illegal or unenforceable, the validity, legality and enforceability of the rest of these Rules will not be affected. Suzuki’s failure to enforce any term of these Rules will not constitute a waiver of that provision.
22. Disputes: Subject to the “Law and Jurisdiction” section below, if there is a dispute about the Promotion or these Rules, Suzuki’s decisions are final. If there is a conflict between these Rules and any other document referred to in these Rules, these Rules take precedence to the extent necessary to resolve the conflict.
23. Law and jurisdiction: The Promotion and these Rules are governed by English law, and any disputes arising in connection with them shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that residents of Scotland and Northern Ireland may also bring proceedings in their own jurisdiction.
